1. Agreement to Official Rules. Participation in Volvo Construction Equipment’s Volvo Ship Fair Contest (the “Sweepstakes”) constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor (as defined below), which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Sponsor. The Sweepstakes is sponsored by Volvo Construction Equipment North America, LLC, 304 Volvo Way, Shippensburg, PA 17257 (“Sponsor”). FACEBOOK®, INSTAGRAM®, LINKEDIN® AND TWITTER® ARE NOT SPONSORS OF THE SWEEPSTAKES AND THE SWEEPSTAKES IS IN NO WAY SPONSORED, ENDORSED OR ADMINISTERED BY, OR ASSOCIATED WITH FACEBOOK®, INSTAGRAM®, LINKEDIN® OR TWITTER®.
3. Eligibility. The Sweepstakes is open to legal residents of, and physically located within, the United States and the District of Columbia (excluding residents of Puerto Rico and the U.S. Territories and Possessions), who are at least eighteen (18) years of age (or the age of majority in their state of residency) as of the start of the Sweepstakes Entry Period (as defined below). All directors, officers and employees of Sponsor and its parent company, subsidiaries, affiliates, sales representatives, distributors, dealers, licensees, agents, attorneys, advertising and Sweepstakes agencies, and each of their immediate family members, and those living in the same household as each, are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, provincial, and local laws and regulations. VOID IN PUERTO RICO, THE U.S. TERRITORIES AND POSSESSIONS AND WHERE PROHIBITED OR RESTRICTED BY LAW OR REGULATION.
4. Entry Period. The Sweepstakes entry period starts on July 26, 2023 at 9:00am EST and ends on July 26, 2023 at 5:00pm EST (the “Entry Period”). Sponsor’s computer system shall be the official time-keeping device for the Sweepstakes.
5. How to Enter. To enter the Sweepstakes, during the Entry Period, an eligible entrant must: (1) “tag” the Sponsor’s Sweepstakes post on Instagram or Facebook (2) “comment on” Sponsor’s Sweepstakes post on with tagging Volvo CE with #Volvo Ship Fair Contest (the “Requirements”). Eligible entrants who successfully complete the Requirements will receive one (1) entry in the Sweepstakes. There is a limit of one (1) entry per person in the Sweepstakes. Sponsor is not responsible for an eligible entrant’s failure to successfully complete the Requirements for any reason whatsoever including technical or human error.
6. Prize. There will be one (1) prize available to be won by eligible entrants that successfully complete the Requirements. Subject to these Official Rules, one will be selected. The prize to be awarded to the winner is a A60H Bruder Model with an approximate retail value (ARV) of $98.00.
All prizes are non-transferable, and no cash redemption or prize substitution is allowed, except in Sponsor’s sole discretion. Sponsor reserves the right to substitute a prize of comparable or greater value, at its sole discretion if the prize cannot be awarded for whatever reason. WINNER IS FULLY RESPONSIBLE FOR ANY AND ALL APPLICABLE FEDERAL, STATE, AND LOCAL TAXES. If required by law, Sponsor reserves the right to withhold and remit the amount of any taxes due to the appropriate taxing authorities.
All prizes will be delivered to the respective winner by overnight mail to the winner’s residential address or as agreed to by Sponsor in its sole discretion. The cost of delivery by mail shall be paid by Sponsor. Sponsor shall not be liable for any lost, late, delayed or damaged prize.
7. Selection of Winner. A winner shall be selected by random drawing no later than July 28, 2023 at 3:00pm EST from all eligible entrants that successfully completed the Requirements. A selected entrant will be notified by the Sponsor within five (5) days of the random drawing by the Winner’s social media account.
In order to be declared a winner, and without limitation of any other terms herein, a selected entrant may be required upon Sponsor’s reasonable request to provide satisfactory proof, as determined by Sponsor in its sole discretion, that such potential winner is an eligible entrant, including but not limited to providing a copy of a potential winner’s government-issued identification and/or additional information required by Sponsor in order to verify eligibility and compliance with these Official Rules.
In order to be declared a winner, a selected entrant may be required to complete, sign and return an affidavit of eligibility and liability release; and unless prohibited by law, a publicity release (collectively, the “Prize Claim Documents”). In the event that the selected entrant fails to complete, sign and return the Prize Claim Documents (if required) within fourteen (14) days of first attempted notification of selection, the prize may be forfeited. Sponsor may award a prize to an alternate winner by random drawing from among all remaining eligible entrants that have successfully completed the Requirements. There will be 0 alternate drawings after which the applicable prize will remain unawarded. No more than the stated number of prizes will be awarded for any reason. No entrant may win more than one (1) prize.
8. Odds of Winning. The odds of winning a prize depends upon the total number of eligible entrants that have successfully completed the Requirements and otherwise complied with these Official Rules.
9. Conditions/Use Rights. By accepting a prize, each entrant consents to the use of their names, voices, and likenesses, including all accompanying personally identifiable information entrant submits or Sponsor obtains in the course of entrant accepting any prize, via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution or compensation (other than the specific prizes described herein) to entrant, his/her successors or assigns, or any other entity, except where prohibited by law.
10. Privacy. By participating in the Sweepstakes, including redeeming any prize, entrant authorizes Sponsor to collect, use, process, transfer and store all data provided by entrant, including without limitation, personal data, to the United States, or any location(s) throughout the world that Sponsor deems necessary, whether within entrant’s country of residence or elsewhere, and with such parties as Sponsor deems appropriate, for purposes of administration of the Sweepstakes. All information submitted to Sponsor as part of this Sweepstakes will be treated in accordance with Sponsor’s privacy policy, available at www.volvoce.com/united-states/en-us/privacy. Personal information will be used to: (a) provide information about the Sweepstakes; (b) contact selected entrants; and (c) publicize winners. Entrants may have the right to withdraw and correct their personal data.
11. Release and Limitations on Liability. By participating in all or a portion of the Sweepstakes, entrants agree, to the extent permitted by law, to release and hold harmless all directors, officers and employees of Sponsor and its parent company, subsidiaries, affiliates, sales representatives, dealers, distributors, licensees, agents, attorneys, advertising and Sweepstakes agencies (the “Released Parties”) from and against any claims, costs, injuries, losses and damages of any kind (including, without limitation, reasonable attorneys’ and investigation fees, expert and consultant fees, and other litigation costs) (collectively, “Losses”) arising out of or in connection with the Sweepstakes, whether under a theory of contract, tort (including negligence), warranty or other theory, including but not limited to: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) errors in the administration of the Sweepstakes or the processing of entries; or (d) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or acceptance, receipt, use, or misuse of a prize (including personal injuries, death, or damage to or destruction or property); and (d) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, rights of publicity or privacy, or defamation or portrayal in a false light, whether intentional or unintentional. In the event that an entrant breaches any of his/her representations, warranties, or undertakings contained herein, Released Parties shall be entitled to and may seek indemnification from entrant for recovery of all legal fees, damages, costs, claims, and other expenses that may be incurred by Released Parties as a result of the aforementioned breach.
12. Miscellaneous. The decisions of Sponsor are final with respect to all aspects of this Sweepstakes. The Sweepstakes and these Official Rules will be governed, construed and interpreted under the laws of the Commonwealth of Pennsylvania without regard to choice of law principles. Entrants specifically agree that (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Middle District of Pennsylvania in Harrisburg, Pennsylvania, or the Court of Common Pleas of Franklin County located in Chambersburg, Pennsylvania; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, the operation of the Sweepstakes, to be acting in violation of these Official Rules or any applicable laws relating to the Sweepstakes, or in an unsportsmanlike or disruptive manner, and to resolve all disputes in its sole discretion. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
13. Identification of Winners. Where required by law, the names of the Winners are available after July 28, 2023 by sending a self-addressed, stamped envelope to: Volvo Construction Equipment North America, LLC, c/o Volvo Construction Equipment’s Volvo Ship Fair Contest, 304 Volvo Way, Shippensburg, PA 17257.
14. Termination. Sponsor reserves the right in its sole discretion to terminate the Sweepstakes or modify, amend or suspend the Sweepstakes and/or the Official Rules, in any way and for whatever reason without prior notice.
