Volvo Construction Equipment’s “Goin’ For Gold Scratch Off Sweepstakes” - Official Rules

NO PURCHASE NECESSARY TO WIN. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE YOUR CHANCES OF WINNING.

1. Agreement to Official Rules. Participation in Volvo Construction Equipment’s “Goin’ For Gold Scratch Off Sweepstakes” (the “Sweepstakes”) constitutes entrant's full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor (as defined below), which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein. The Sweepstakes is sponsored by Volvo Construction Equipment North America, LLC, 304 Volvo Way, Shippensburg, PA 17257 (“Sponsor”).

2. Odds. The odds of receiving a coupon or winning a prize are set forth under Section 7 below.

3. Eligibility. The Sweepstakes is open only to legal residents of, and physically located within, any of the fifty (50) United States (including District of Columbia, but excluding New York and Florida) or of Canada (excluding the Province of Quebec), who are at least eighteen (18) years of age (or the applicable age of majority if greater) as of the date of entry. All directors, officers and employees of Sponsor, and its parent companies, subsidiaries, affiliates, sales representatives, distributors, licensees, agents, advertising and Sweepstakes agencies, and each of their immediate family members (spouses, parents, children, and siblings and their respective spouses), and those living in the same household as each, are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state, provincial, and local laws and regulations. Void where prohibited.

4. Entry Period. The Sweepstakes entry period begins on March 10, 2020 at 9:00 am Pacific Standard Time (“PST”) and ends on March 14, 2020 at 3:00 pm PST (the “Entry Period”). Sponsor’s computer shall be the official time-keeping device for the Sweepstakes.

5. How to Enter. To enter the Sweepstakes, during the Entry Period, visit Sponsor’s Outdoor Booth #F3432 (the “Sponsor Booth") at the CONEXPO-CON/AGG 2020 Conference located at the Las Vegas Festival Grounds, 311 West Sahara Ave., Las Vegas, NV 89101 (the “Conference”), and provide to Sponsor’s designated representative at the Information Desk located in the Sponsor Booth entrant’s conference badge for scanning in order to register entrant’s name, email address, home address and telephone number. Each entrant will receive one (1) “Scratch Card” Game Piece (the “Game Piece”). Limit of one (1) Game Piece per person/per email address/per calendar day in the Sweepstakes through the Entry Period.

6. How to Play. Carefully remove the scratch-off surface on your Game Piece to reveal your coupon offer or prize description printed beneath the scratch-off surface.

IMPORTANT NOTICE: If the Game Piece, or any coupon offer or prize description printed beneath the scratch off-surface of the Game Piece, has been tampered with, altered, damaged, destroyed, made illegible, lost, mutilated, altered, copied, hand printed, water damaged, manipulated, removed, replaced in any manner, or which are defective or that contain any computer programming, printing, production, mechanical, or typographical errors or errors in production, then the Game Piece, and any coupon offer or prize description printed beneath the scratch-off surface of the Game Piece, will be void and will not be eligible for any coupon redemption or prize claim. All Game Pieces submitted for coupon redemption or prize claim are subject to verification and approval. Game Pieces presented for coupon redemption or prize claim must be the original Game Piece. Entrants in possession of a defective or damaged Game Piece may only receive a replacement Game Piece in exchange for such defective or damaged Game Piece, unless such damage is deemed to have been intentionally caused by entrant, in which case the Game Piece is void and will not be replaced. Sponsor’s total liability for any defective or damaged Game Piece received by an entrant is limited to replacement with another Game Piece, while supplies last. Any error, omission, or defect in printing, production, programming, or seeding that changes the odds of winning on any Game Piece, or the scheduled number of coupon offers, will render all such Game Pieces void. No more than the scheduled number of coupon offers or prizes will be awarded for any reason (see below). Any attempt to submit a fraudulently or intentionally altered, tampered with, or manipulated Game Piece may be a crime subject to civil and criminal prosecution. Sponsor reserves the right to prosecute any entrant submitting such a fraudulently or intentionally altered, tampered with, or manipulated Game Piece to the fullest extent of the law.

7. Coupon Offers and Prize Descriptions. The coupon offers and prizes available in this Sweepstakes, including odds of receiving or winning (as applicable), total number available, and approximate retail value (“ARV”), if any, of each is as follows:

8. How to Redeem a Coupon Offer or Prize Award: All winning Game Pieces must be redeemed at the Information Desk in the Sponsor Booth by March 14, 2020 at 3:00 pm PST. Only one (1) winning Game Piece may be redeemed per person/per email address/per calendar day in the Sweepstakes. Each entrant in possession of a winning Game Piece must have their Conference badge scanned at the Sponsor’s Information Desk and provide all the required information. Sponsor’s designated representative will provide entrant in possession of a winning Game Piece with an official claim form to complete and submit with the original winning Game Piece. Any Game Pieces presented, redeemed, or received for coupon offers or prize redemption after the above stated deadline shall be void and ineligible for prize award or coupon redemption. Only Game Pieces that are actually received in accordance with these Official Rules are eligible for coupon redemption or prize award. Sponsor is not responsible for any late, lost, or undelivered Game Piece, or any prize claim or coupon redemption not submitted according to the requirements of these Official Rules, or not received for any reason.

In order to be confirmed as a winner, and without limitation of any other terms herein, each potential winner may be required upon Sponsor’s reasonable request to provide satisfactory proof, as determined by Sponsor in its sole discretion, that such potential winner is an eligible entrant, including but not limited to providing a copy of a potential winner’s government-issued identification and/or additional information required by Sponsor in order to verify eligibility and compliance with these Official Rules. Each potential winner of any prize in excess of $600 will be required to execute and return: (1) an affidavit of eligibility and liability release; (2) W-9 form (if prize value exceeds $600), and, (3) unless prohibited by law, a publicity release (collectively, the “Prize Claim Documents”). All prize winners, if any, of awarded prizes in excess of $600 will be issued an IRS Form 1099 reflecting the actual value of the prize. The Prize Claim Documents will be provided to each potential winner to be completed and returned to Sponsor within fourteen (14)] days following the Conference. In the event that the potential winner fails to sign and return the Prize Claim Documents (if required) within the required time period, or if a potential winner is disqualified for any other reason, Sponsor may award the prize to an alternate winner by random drawing from among all remaining eligible entries, time permitting. There will be three (3) alternate drawings after which the applicable prize will remain unawarded.

Upon verifying a prize winner, Sponsor will either provide the applicable prize voucher to the winner at the Conference or will email the applicable prize voucher to the email address provided by the prize winner during the verification process. Allow 4 weeks for receipt of all emailed prize vouchers. Sponsor is not responsible for lost, late, delayed, mutilated, or damaged emailing of any prize voucher.

9. Additional Terms and Conditions for Coupon Offer and Prize Awards:
Total ARV of all available prize awards: $469,480. No interest will be paid on any prize. If required by law, Sponsor reserves the right to withhold and remit to the appropriate taxing authorities the amount of any taxes due. The winner is fully responsible for any and all applicable federal, state, and local taxes. All costs and expenses associated with prize acceptance and use not specified herein as being provided are the sole responsibility of the winner.

Each coupon offer limited to one (1) qualifying purchase per winner. Any merchandise purchased at the coupon discount will only be refunded (if permitted) at the actual price paid after discount. Coupon discount has no monetary or cash value. Not valid for online purchases. Not valid for purchase of gift cards or for credit on applicable taxes. Not applicable to prior purchases. Coupon discount cannot be combined with other coupons or discounts. Additional terms, conditions,
exclusions, and restrictions may apply. Sponsor reserves the right (in its discretion) to disallow coupon discounts that were issued in error or that were not earned legitimately.

All validly redeemed coupon offers or claimed prizes will be awarded, subject to Game Piece approval and verification of eligibility and compliance with the terms of these Official Rules. Any unclaimed coupon offers or prize awards will not be awarded, and will remain property of Sponsor, and will not be re-awarded. No more than the advertised maximum number of coupon offers or prize awards as listed above will be awarded for any reason. If, due to printing, production, programming, seeding, typographical, human, or other errors of any kind, the number of valid coupon offers or prize awards distributed or received at any level exceeds the number of coupon offers or prize awards advertised or intended to be distributed or awarded as stated herein, then Sponsor reserves the right to conduct and award the stated number of coupon offers or prize awards for such level in a random drawing from among all valid, non-suspect claims received for that coupon offer or prize award level. Any additional prize award claims received by Sponsor after a prize has been exhausted for any particular prize level will be void. All Game Pieces, coupon offers and prize awards are non-transferable, and no cash redemption or prize substitution allowed, except at Sponsor’s sole discretion or as provided herein. Sponsor reserves the right to substitute a coupon offer or prize award of comparable or greater value, at its sole discretion.

10. Conditions/Use Rights. By accepting any coupon offer or prize award, each entrant consents to the use of their names, voices, and likenesses, including all accompanying personally identifiable information entrant submits or Sponsor obtains in the course of entrant accepting any prize or coupon, via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution or compensation (other than the specific prizes described herein) to entrant, his/her successors or assigns, or any other entity, except where prohibited by law.

11. Privacy. By participating in the Sweepstakes, including redeeming any coupon offer or prize award, entrant authorizes Sponsor to collect, use, process, transfer and store all data provided by entrant, including without limitation, personal data, to the United States, or any location(s) throughout the world that Sponsor deems necessary, whether within entrant’s country of residence or elsewhere, and with such party(ies) as Sponsor deems appropriate, for purposes of administration of the Sweepstakes. All information submitted to Sponsor as part of this Sweepstakes will be treated in accordance with Sponsor’s privacy policy, available at https://www.volvogroup.com/en-en/privacy.html. Personal information will be used only to: (a) provide information about the Sweepstakes; (b) contact and publicize potential winners; or (c) if an entrant selects to receive additional information from Sponsor on the entry form, to send additional information to that entrant during or after any Entry Period. Entrants have the right to withdraw and correct their personal data, but entrants are not allowed to re-submit their entries. Directions on procedures for submitting corrections to personal data are provided in the privacy policy of Sponsor.

12. Release and Limitations on Liability. By participating in all or a portion of the Sweepstakes, entrants agree, to the extent permitted by law, to release and hold harmless all directors, officers and employees of Sponsor and its parent companies, subsidiaries, affiliates, sales representatives, distributors, licensees, agents, advertising, and Sweepstakes agencies (the “Released Parties”) from and against any claims, costs, injuries, losses and damages of any kind (including, without limitation, reasonable attorneys’ and investigation fees, expert and consultant fees, and other litigation costs) (collectively, “Losses”) arising out of or in connection with the Sweepstakes, whether under a theory of contract, tort (including negligence), warranty or other theory, including: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors
related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, incorrect, garbled, or incompletely received entries; (e) errors in the administration of the Sweepstakes or the processing of entries; or (f
) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Sweepstakes or acceptance, receipt, use, or misuse of any coupon offer or prize (including personal injuries, death, or damage to or destruction or property), or travel to any Sweepstakes-related events; and (g) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, rights of publicity or privacy, or defamation or portrayal in a false light, whether intentional or unintentional. In the event that entrant breaches any of his/her representations, warranties, or undertakings contained herein, Released Parties shall be entitled to and may seek indemnification from entrant for recovery of all legal fees, damages, costs, claims, and other expenses that may be incurred by Released Parties as a result of the aforementioned breach.

13. Miscellaneous. The decisions of Sponsor are final with respect to all aspects of this Sweepstakes. The Sweepstakes and these Official Rules will be governed, construed and interpreted under the laws of the Commonwealth of Pennsylvania without regard to choice of law principles. Entrants specifically agree that (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Middle District of Pennsylvania in Harrisburg, Pennsylvania, or the Court of Common Pleas of Franklin County located in Chambersburg, Pennsylvania; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. For purposes of these Official Rules, (a) the words “include,” “includes” and “including” shall be deemed to be followed by the words “without limitation”; (b) the word “or” is not exclusive; and (c) the words “herein,” “hereof,” “hereby,” “hereto,” and “hereunder” refer to these Official Rules as a whole. In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including fraud, virus, or other technical problems, or any condition caused by events beyond the reasonable control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted, Sponsor may, in its sole discretion, either: (a) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (b) award the outstanding coupon offers and prizes from among the non-suspect, eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, the operation of the Sweepstakes, to be acting in violation of these Official Rules or any applicable laws relating to the Sweepstakes, or in an unsportsmanlike or disruptive manner, and to resolve all disputes in its sole discretion. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

14. Winners List; Official Rules. For notification of the winner or a copy of these Official Rules, send a self-addressed, stamped envelope to: Volvo Construction Equipment North America, LLC, c/o Volvo Construction Equipment’s “Goin’ for Gold Scratch Off Sweepstakes”, 304 Volvo Way, Shippensburg, PA 17257. Requests for the winners list will only be accepted after the end of the Entry Period and must be received by September 30, 2020.

15. Sponsor. The Sponsor of this Sweepstakes is Volvo Construction Equipment North America, LLC. Entrants shall not use the trademarks of Sponsor or falsely associate themselves with Sponsor during or after the Entry Period.
