BY ENTERING THIS GIVEAWAY, YOU ACKNOWLEDGE THAT THESE OFFICIAL RULES FORM A BINDING LEGAL CONTRACT, SO READ THEM CAREFULLY BEFORE PARTICIPATING. WITHOUT LIMITATION, THIS CONTRACT PROVIDES FOR YOUR INDEMNIFICATION OF THE SPONSOR AND OTHER PARTIES AND THE WAIVER OF THE RIGHTS TO PARTICIPATE IN A CLASS ACTION.

1. Agreement to Official Rules.  Participation in Volvo Construction Equipment’s Volvo Passport Giveaway (the “Giveaway”) constitutes your full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor (as defined below), which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein. 

2. Odds.  The odds of winning a prize are set forth under Section 6 below.

3. Eligibility. The Giveaway is open to attendees of CONEXPO-CON/AGG construction trade show (“CONEXPO”), who are physically present at the Las Vegas Convention Center, 3150 Paradise Road, Las Vegas, NV 89109, at least eighteen (18) years of age (or the applicable age of majority, if greater in their state or country of residence) as of the date of participation, and who (i) visit Sponsor’s booth no. F24029 at CONEXPO (“Sponsor’s Booth”) and (ii) have an active Passport Account. Creating a Passport Account is free, and CONEXPO attendees can do so by scanning their valid CONEXPO badge at Sponsor’s Booth, downloading the app, and following the instructions provided. All directors, officers, and employees of Volvo Construction Equipment North America, LLC (“Sponsor”) or any other original equipment manufacturer, and their respective parent companies, subsidiaries, affiliates, sales representatives, distributors, dealers, licensees, agents, advertising and Giveaway agencies, and each of their immediate family members (spouses, parents, children, and siblings, and their respective spouses), and those living in the same household as each, are not eligible to participate in the Giveaway. Void where prohibited and subject to all applicable U.S. federal, state, and local laws and regulations. Sponsor may disqualify participants where participation would be unlawful. Not open to residents of jurisdictions embargoed by the U.S. or where Sponsor is prohibited from doing business. 

4. Participation Period. The Giveaway begins on March 3, 2026 at 9:00 a.m. Pacific Standard Time (“PST”) when the CONEXPO begins and ends on March 7, 2026 at 3:00 p.m. PST, when CONEXPO ends or when all Volvo Swag Prizes (as defined below) have been redeemed, whichever is earlier (the “Promotional Period”). Sponsor’s computer shall be the official time-keeping device for the Giveaway.

5. How to Participate. Participation in the Giveaway requires (i) the download of the Volvo Passport app and (ii) an active Passport Account. To participate in the Giveaway, during the Promotional Period, eligible participants must complete the following steps: 

• Visit Sponsor’s Booth
• Scan valid CONEXPO Badge to download the Passport app and create a Passport Account (if one has not already been created)
• Using the Passport app, scan the various QR Codes available at Sponsor’s Booth. Each scan will result in the accumulation of points within the Passport app. The number of points associated with each QR Code varies and will be disclosed by Sponsor or Sponsor’s representative at Sponsor’s Booth at the time of scan.
• Continue scanning QR Codes at Sponsor’s Booth until you have accumulated the requisite number of points to be eligible to spin the online wheel (“Wheel”) for a chance to win a “Volvo Swag Prize.” 

To be eligible to spin the Wheel, participants must accumulate at least forty-five (45) points. Eligible participants may only spin the Wheel one (1) time during the Promotional Period. The more points a participant accumulates, the more prize tiers (“Tiers”) will become available on the Wheel as set forth in the chart below. Each participant who spins the Wheel will be eligible to win only one (1) of the Volvo Swag Prizes as set forth in the chart below subject to (i) accumulation of the minimum number of points to access the eligible Tier; (ii) availability of Volvo Swag Prize; and (iii) while supplies last. LIMIT ONE PRIZE PER PERSON. 

Sponsor is not responsible for a participant’s failure to accumulate points for any reason whatsoever including technical or human error or for any Volvo Swag Prize no longer being available by the time a participant has accumulated enough points to spin the Wheel. 

When a participant spins the Wheel, only the available Volvo Swag Prizes in the applicable Tiers will be visible. The Wheel will land on a Volvo Swag Prize, and a message will appear in the Passport app (“Prize Message”). Participants must show the Prize Message to Sponsor’s representative at the Sponsor’s Booth to redeem the applicable Volvo Swag Prize as set forth in Section 7 below. 

6. Prizes.  The Volvo Swag Prizes and their approximate retail value (“ARV”) are set forth in the chart below:

The odds of winning a Volvo Swag Prize depend upon the number of participants who accumulate the required points as set forth above.

The Volvo Swag Prizes are non-transferable, non-exchangeable and no cash redemption or prize substitution is allowed, except in Sponsor’s sole discretion. Sponsor reserves the right to substitute a Volvo Swag Prize of comparable or greater value, at its sole discretion if a Volvo Swag Prize cannot be awarded for whatever reason. WINNER IS FULLY RESPONSIBLE FOR ANY AND ALL FEDERAL, STATE, PROVINCIAL, OR LOCAL TAXES, LIABILITIES, FEES, AND/OR EXPENSES AS MAY BE APPLICABLE TO THE ACCEPTANCE AND USE OF A VOLVO SWAG PRIZE. If required by law, Sponsor reserves the right to withhold and remit the amount of any taxes due to the appropriate taxing authorities. 

7. Redemption of Prizes. Participants may claim their Volvo Swag Prize at Sponsor’s Booth by showing their Prize Message on the Passport app to a Sponsor representative during the Promotional Period. All Prizes must be claimed prior to the end of the Promotional Period or will be forfeited. If Volvo Swag Prize on the Prize Message is no longer available at the time of redemption, Volvo reserves the right to substitute the Volvo Swag Prize with a Volvo Swag Prize of equal or greater value.

No more than the stated number of Volvo Swag Prizes will be available to be awarded except in Sponsor’s sole discretion.

8. Conditions/Use Rights. By accepting a Volvo Swag Prize, each participant consents to the use of their names, voices, and likenesses (which use may be confirmed in writing, at Sponsor’s request), including all accompanying personally identifiable information participant submits or Sponsor obtains in the course of participant accepting any Volvo Swag Prize, via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution or compensation (other than the specific Volvo Swag Prizes described herein) to participant, his/her successors or assigns, or any other entity, except where prohibited by law. Participants who are residents of countries other than the U.S. and Canada may be required to sign a Publicity Release in order to receive a Volvo Swag Prize.

9. Privacy.  By entering the Giveaway, participants consent to Sponsor collecting, using, processing, transferring and storing the information you provide, including without limitation, personal information, in the United States, or any other location worldwide, that Sponsor deems necessary, whether within your country of residence or elsewhere, and with such party(ies) as Sponsor deems appropriate, for purposes of administration of the Giveaway and to send marketing communication and promotional materials that may be of interest to you about Sponsor’s products and services. You have the right to withdraw and correct your personal information. Directions on procedures for submitting corrections to personal information are provided in the privacy notices set forth below. All information submitted to Sponsor as part of this Giveaway, will be treated in accordance with Sponsor’s privacy notice, available at https://www.volvoce.com/united-states/en-us/privacy/ and the Volvo Group’s privacy notice, available at https://www.volvogroup.com/en/tools/privacy.html. Where required by applicable law, appropriate safeguards will be implemented for any international transfers.

10. Release and Limitations on Liability.  By participating in any portion of the Giveaway, participant agrees, to the extent permitted by law, to release and hold harmless Sponsor, all directors, officers and employees of Sponsor and its parent company, subsidiaries, affiliates, sales representatives, distributors, dealers, licensees, agents, advertising agencies, and any entity involved in the administration, or prize fulfillment of the Giveaway (the “Released Parties”) from and against any claims, costs, injuries, losses and damages of any kind (including, without limitation, reasonable attorneys’ and investigation fees, expert and consultant fees, and other litigation costs) (collectively, “Losses”) arising out of or in connection with the Giveaway, whether under a theory of contract, tort (including negligence), warranty or other theory, including: (a) unauthorized human intervention in the Giveaway; (b) technical errors or malfunctions related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, incorrect, garbled, or incompletely received entries; (e) errors in the administration of the Giveaway or the processing of entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the participant’s participation in the Giveaway, acceptance, receipt, use, or misuse of any prize (including personal injuries, death, or damage to or destruction or property), or travel to any Giveaway-related events, or the visiting of a website or the downloading of any applications; and (g) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, rights of publicity or privacy, or defamation or portrayal in a false light, whether intentional or unintentional. In the event that the participant breaches any of his/her representations, warranties, or undertakings contained herein, Released Parties shall be entitled to and may seek indemnification from the participant for recovery of all legal fees, damages, costs, claims, and other expenses that may be incurred by Released Parties as a result of the aforementioned breach. You acknowledge and agree that all rights under Section 1542 of the Civil Code of California and any law or legal principle of similar effect in any jurisdiction that may be applicable to the foregoing release are hereby waived. Section 1542 provides: 

A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.

WITHOUT LIMITING THE FOREGOING, EVERYTHING REGARDING THIS GIVEAWAY, INCLUDING ALL PRIZES, IS PROVIDED “AS IS” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11. Miscellaneous. The decisions of Sponsor are final with respect to all aspects of this Giveaway. The Giveaway and these Official Rules will be governed, construed and interpreted under the laws of the Commonwealth of Pennsylvania, USA, without regard to choice of law principles. Each participant specifically agrees that (1) any and all disputes, claims and causes of action arising out of or connected with this Giveaway or any prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Middle District of Pennsylvania in Harrisburg, Pennsylvania, or the Court of Common Pleas of Franklin County located in Chambersburg, Pennsylvania; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred up to $200.00, but in no event attorneys’ fees; and (3) under no circumstances will an participant be permitted to obtain awards for, and each participant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. This provision does not deprive a consumer participant of any non-waivable statutory rights to bring claims in their courts of their residence under applicable mandatory laws. For purposes of these Official Rules, (a) the words “include,” “includes” and “including” shall be deemed to be followed by the words “without limitation”; (b) the word “or” is not exclusive; and (c) the words “herein,” “hereof,” “hereby,” “hereto,” and “hereunder” refer to these Official Rules as a whole. In the event that the operation, security, or administration of the Giveaway is impaired in any way for any reason, including fraud, virus, or other technical problems, or any condition caused by events beyond the reasonable control of Sponsor that may cause the Giveaway to be disrupted, corrupted, or incapable of operating as planned, Sponsor may, in its sole discretion, either: (a) cancel or terminate the Giveaway (or any portion thereof); (b) suspend the Giveaway to address the impairment and then resume the Giveaway in a manner that best conforms to the spirit of these Official Rules; or (c) award the outstanding prizes from among the non-suspect, eligible entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, the operation of the Giveaway, to be acting in violation of these Official Rules or any applicable laws relating to the Giveaway, or in an unsportsmanlike or disruptive manner, and to resolve all disputes in its sole discretion. Any attempt by any person to undermine the legitimate operation of the Giveaway may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to prosecute and seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision. 

12. Winner List; Official Rules. For notification of the winner or a copy of these Official Rules, send a self-addressed, stamped envelope to: Volvo Construction Equipment North America, LLC, c/o Volvo Construction Equipment’s “Volvo Passport” Giveaway, 312 Volvo Way, Shippensburg, PA 17257. Requests for the winner list must be received within 60 days of the end of the Promotional Period.

13. Sponsor. The Sponsor of this Sweepstakes is Volvo Construction Equipment North America, LLC, 312 Volvo Way, Shippensburg, PA 17257 . Participants shall not use the trademarks of Sponsor or falsely associate themselves with Sponsor during or after the Giveaway.
