NO PURCHASE OR PAYMENT IS NECESSARY TO ENTER OR WIN THIS SWEEPSTAKES. A PURCHASE OR PAYMENT OF ANY KIND WILL NOT INCREASE THE LIKELIHOOD OF AN ENTRANT WINNING THE SWEEPSTAKES. BY ENTERING THIS SWEEPSTAKES, YOU ACKNOWLEDGE THAT THESE OFFICIAL RULES FORM A BINDING LEGAL CONTRACT, SO READ THEM CAREFULLY BEFORE PARTICIPATING. WITHOUT LIMITATION, THIS CONTRACT PROVIDES FOR YOUR INDEMNIFICATION OF THE SPONSOR AND OTHER PARTIES AND THE WAIVER OF THE RIGHTS TO PARTICIPATE IN A CLASS ACTION.
1. Agreement to Official Rules. Participation in Volvo Construction Equipment’s CONEXPO VIP Experience Sweepstakes (the “Sweepstakes”) constitutes entrant’s full and unconditional agreement to and acceptance of these Official Rules and the decisions of Sponsor (as defined below), which are final and binding. Winning a prize is contingent upon fulfilling all requirements set forth herein.
2. Eligibility. The Sweepstakes is open to U.S. legal residents who are physically located in one of the fifty (50) states or the District of Columbia and are at least twenty-one (21) years of age as of the date of entry. All directors, officers, and employees of Sponsor or any other original equipment manufacturer, and their respective parent companies, subsidiaries, affiliates, sales representatives, distributors, dealers, licensees, agents, advertising and Sweepstakes agencies, and each of their immediate family members (spouses, parents, children, and siblings, and their respective spouses), and those living in the same household as each, are not eligible to participate in the Sweepstakes. The Sweepstakes is subject to all applicable federal, state and local laws and regulations. Void where prohibited.
3. Entry Period. The Sweepstakes entry period starts on November 17, 2025 at 12:00 a.m. Eastern Standard Time (“EST”) and ends on January 30, 2026, at 11:59 p.m. EST (the “Entry Period”). Entrants must submit an Entry (as defined in Section 4) by no later than January 30, 2026, at 11:59 p.m. EST. Sponsor’s computer system shall be the official time-keeping device for the Sweepstakes.
4. How to Enter. To enter the Sweepstakes, during the Entry Period, an entrant must electronically complete and submit the entry form available on Sponsor’s website including full name, email address, mobile phone, company name, company postal code, company country and company industry (each an “Entry”). Entrants who successfully complete the Entry will receive one (1) entry in the Sweepstakes. There is a limit of one (1) Entry per person in the Sweepstakes. Any attempt by any entrant to obtain more than the stated number Entries by using multiple and/or different identities, email addresses, or any other methods will void that entrant’s Entries, and that entrant may be disqualified at Sponsor’s discretion. Sponsor is not responsible for an entrant’s failure to successfully complete the Entry for any reason whatsoever including technical or human error. By submitting an entry form, I agree to receive marketing communications and promotional materials that may be of interest to you about Sponsor’s products and services. An entrant may unsubscribe at any time by following the instructions in the communication or material.
5. Prize/Approximate Retail Value (“ARV”). The Prize (1): A 4-day, 3-night trip for the winner and one (1) guest to Las Vegas, Nevada from March 3, 2026 to March 6, 2026. The Prize includes :
The ARV of the Prize is $3,750 , but may vary depending on the point of departure and fluctuations in cost of air transportation and hotel accommodations. Any difference between the ARV and actual value of the Prize will not be awarded.
If the winner resides within a 100-mile radius of Las Vegas, Nevada, Sponsor reserves the right to substitute round-trip ground transportation between the winner’s residence and the Hotel in lieu of air transportation. If a winner travels via ground transportation due to geographic proximity, no compensation will be provided for any difference in the Prize’s ARV compared to a winner who travels by air.
Travel must be round-trip. The winner and guest must travel together on the same itinerary. Airline tickets, hotel accommodations and car service must be booked via Sponsor. Air carrier, Hotel and the car service’s regulations and conditions apply.
A representative of Sponsor will contact the winner to arrange travel upon receipt of the Prize Claim Documents and Guest Release Documents (both defined below). Sponsor has not and will not purchase travel insurance or any other insurance for the trip. Once travel arrangements are made, they may not be altered except at Sponsor’s discretion. Airline tickets issued in connection with the Prize may not be eligible for frequent flyer miles or upgrades. No stopovers are permitted on tickets issued as part of the Prize. If a stopover occurs, Prize travel will terminate, and the winner and guest will be responsible for the full fare from the stopover point for the remaining trip segment(s), including the return.
The winner’s guest must be at least twenty-one (21) years of age as of January 30, 2026, and will be required to sign a liability release and, unless prohibited by law, a publicity release in a form provided by Sponsor (the “Guest Release Documents”). The winner must return the Guest Release Documents to Sponsor before travel is booked. If the winner elects to travel or participate without a guest, no additional compensation will be awarded for the guest’s portion of the Prize.
All travelers must have valid travel documents prior to departure. Travel must be completed on the specified dates or the Prize will be forfeited. No refund or compensation will be made in the event of the cancellation or delay of any flight, except at the sole discretion of Sponsor. Sponsor shall not be responsible for any cancellations, delays, diversions or substitutions or any act or omissions whatsoever by any air carrier(s), transportation companies, or other persons providing travel-related services, including any resulting changes in services or accommodations.
All expenses and costs not expressly listed above are the sole responsibility of winner. The winner may be required to provide a valid major credit card upon check-in at the Hotel, and all in-room charges, room service, telephone calls, incidentals, and other expenses charged to the Hotel room will be charged to that credit card. Any damage to the Hotel room will be the responsibility of winner.
In the event that the winner and/or winner’s guest engages in behavior that Sponsor, in its sole discretion, deems inappropriate, illegal, tortious, intended to annoy, abuse, threaten or harass any other person, or results in arrest or detention, Sponsor reserves the right to terminate the trip early and/or eject the winner and guest from any portion of the trip, with no further compensation to the winner. Sponsor shall have no obligation to pay any damages, fees, fines, judgments or other costs or expenses of any kind whatsoever incurred by winner or guest as a result of such conduct.
SPONSOR SHALL HAVE NO LIABILITY FOR ANY PERSONAL INJURIES, DEATH, DAMAGE TO OR DESTRUCTION OF PROPERTY, OR OTHER DAMAGES OR EXPENSES RESULTING FROM OR ARISING OUT OF ANY TRAVEL RELATED TO THE PRIZE OR ANY OTHER ASPECT OF THE WINNER OR GUEST’S ACCEPTANCE OR USE OF THE PRIZE, OR ANY PORTION THEREOF.
The Prize (including any portion thereof) is non-transferable, and no cash redemption or substitution is allowed, except in Sponsor’s sole discretion. Sponsor reserves the right to substitute the Prize (or any portion thereof) with one of comparable or greater value, at its sole discretion, if the Prize (or any portion thereof) cannot be awarded for whatever reason.
THE WINNER IS FULLY RESPONSIBLE FOR ANY AND ALL APPLICABLE FEDERAL, STATE, AND LOCAL TAXES. The winner will be issued a 1099 tax form for the actual value of the Prize. If required by law, Sponsor reserves the right to withhold and remit the amount of any taxes due to the appropriate taxing authorities. Resale of the Prize is prohibited.
6. Selection of a Potential Winner. A potential winner shall be selected by random drawing on or about February 1, 2026 (the “Drawing Date”) from all eligible Entries received during the Entry Period. A selected entrant will be notified by the Sponsor within two (2) days of the Drawing Date via email. In order to be declared a winner, and without limitation of any other terms herein, a selected entrant must: (1) provide satisfactory proof, as determined by Sponsor in its sole discretion, that they are an eligible entrant. This may include, but is not limited to, submitting a copy of government-issued identification and/or additional information required by Sponsor to verify eligibility and compliance with these Official Rules; (2) complete, sign and return an affidavit of eligibility and liability release, and unless prohibited by law, a publicity release (collectively, the “Prize Claim Documents”) within two (2) business days of notification; and (3) accept the Prize and agree to travel. If the selected entrant fails to provide proof of eligibility, complete, sign and return the Prize Claim Documents, or accept the Prize and agree to travel, the Prize will be forfeited. In such case, an alternate winner may be selected by random drawing. The alternate winner must complete, sign and return the Prize Claim Documents in the specified timeframe. Up to three (3) alternate drawings will be held, after which the Prize will remain unawarded.
7. Odds of Winning. The odds of winning will depend on the total number of eligible Entries received during the Entry Period.
8. Conditions/Use Rights. By accepting the Prize, each entrant consents to the use of their names, voices, and likenesses, including all accompanying personally identifiable information entrant submits or Sponsor obtains in the course of entrant accepting any Prize, via all forms of media now known or hereafter devised worldwide, in perpetuity, without notice, attribution or compensation (other than the specific Prize described herein) to entrant, his/her successors or assigns, or any other entity, except where prohibited by law.
9. Privacy. By entering the Sweepstakes, you consent to Sponsor collecting, using, processing, transferring and storing the information you provide, including without limitation, personal information, in the United States, or any other location worldwide, that Sponsor deems necessary, whether within your country of residence or elsewhere, and with such party(ies) as Sponsor deems appropriate, for purposes of administration of the Sweepstakes and as stated herein. All information submitted to Sponsor as part of this Sweepstakes, will be treated in accordance with Sponsor’s privacy notice, available at www.volvoce.com/united-states/en-us/privacy and the Volvo Group’s privacy notice, available at www.volvogroup.com/en/tools/privacy.html. Your personal information may be used to: (i) provide updates about the Sweepstakes; (ii) contact and announce potential winners; and (iii) send marketing communications and promotional materials that may be of interest to you about Sponsor’s products and services. You have the right to withdraw and correct your personal information, but you are not allowed to re-submit your entry. Directions on procedures for submitting corrections to personal information are provided in the aforementioned privacy notices.
10. Release and Limitations on Liability. By entering the Sweepstakes, you agree, to the extent permitted by law, to release and hold harmless all directors, officers and employees of Sponsor and its parent company, subsidiaries, affiliates, sales representatives, distributors, dealers, licensees, agents, advertising, and Sweepstakes agencies (the “Released Parties”) from and against any claims, costs, injuries, losses and damages of any kind (including, without limitation, reasonable attorneys’ and investigation fees, expert and consultant fees, and other litigation costs) (collectively, “Losses”) arising out of or in connection with the Sweepstakes and/or the Prize, whether under a theory of contract, tort (including negligence), warranty or other theory, including: (a) unauthorized human intervention in the Sweepstakes; (b) technical errors related to computers, servers, providers, or telephone or network lines; (c) printing errors; (d) lost, late, misdirected, incorrect, garbled, or incompletely received Entries; (e) errors in the administration of the Sweepstakes or the processing of Entries; or (f) injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from the entrant’s participation in the Sweepstakes, travel related to the Prize or winner or guest’s acceptance or use of the Prize or travel to or from any Sweepstakes-related events (including personal injuries, death, or damage to or destruction or property); and (g) any claims based on publicity rights, copyright/trademark infringement, intellectual property rights, rights of publicity or privacy, or defamation or portrayal in a false light, whether intentional or unintentional. In the event you breach any of your representations, warranties, or undertakings contained herein, Released Parties shall be entitled to and may seek indemnification from you for recovery of all legal fees, damages, costs, claims, and other expenses that may be incurred by Released Parties as a result of the aforementioned breach. You acknowledge and agree that all rights under Section 1542 of the Civil Code of California and any law or legal principle of similar effect in any jurisdiction that may be applicable to the foregoing release are hereby waived. Section 1542 provides:
A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY.
11. Miscellaneous. The decisions of Sponsor are final with respect to all aspects of this Sweepstakes. The Sweepstakes and these Official Rules will be governed, construed and interpreted under the laws of the Commonwealth of Pennsylvania without regard to choice of law principles. Entrants specifically agree that (1) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes or any Prize shall be resolved individually, without resort to any form of class action, and exclusively by the United States District Court for the Middle District of Pennsylvania in Harrisburg, Pennsylvania, or the Court of Common Pleas of Franklin County located in Chambersburg, Pennsylvania; (2) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred up to $200.00, but in no event attorneys’ fees; and (3) under no circumstances will entrant be permitted to obtain awards for, and entrant hereby waives all rights to claim, indirect, punitive, incidental, and consequential damages, and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. For purposes of these Official Rules, (a) the words “include,” “includes” and “including” shall be deemed to be followed by the words “without limitation”; (b) the word “or” is not exclusive; and (c) the words “herein,” “hereof,” “hereby,” “hereto,” and “hereunder” refer to these Official Rules as a whole. In the event that the operation, security, or administration of the Sweepstakes is impaired in any way for any reason, including fraud, virus, or other technical problems, or any condition caused by events beyond the reasonable control of Sponsor that may cause the Sweepstakes to be disrupted or corrupted, Sponsor may, in its sole discretion, either: (i) suspend the Sweepstakes to address the impairment and then resume the Sweepstakes in a manner that best conforms to the spirit of these Official Rules; or (ii) award the Prize from among the non-suspect, eligible Entries received up to the time of the impairment. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process, the operation of the Sweepstakes, to be acting in violation of these Official Rules or any applicable laws relating to the Sweepstakes, or in an unsportsmanlike or disruptive manner, and to resolve all disputes in its sole discretion. Any attempt by any person to undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.
12. Winner List; Official Rules. For notification of the winner or a copy of these Official Rules, send a self-addressed, stamped envelope to: Volvo Construction Equipment North America, LLC, c/o Volvo Construction Equipment’s CONEXPO VIP Experience, 312 Volvo Way, Shippensburg, PA 17257. Requests for the winner list will only be accepted after the completion of the Sweepstakes and must be received by July 31, 2026.
13. Sponsor. The Sponsor of this Sweepstakes is Volvo Construction Equipment North America, LLC, 312 Volvo Way, Shippensburg, PA 17257 (“Sponsor”). Entrants shall not use the trademarks of Sponsor or falsely associate themselves with Sponsor during or after the Entry Period or the Sweepstakes.
